Employer Wage Assignments FAQ

    How soon should I begin garnishing wages from an employee after receiving a court-ordered wage assignment?

    Wage assignments are effective as soon as possible, but no later than 10 days after receiving the assignment.

    How long do I have to send a check in to your office?

    Seven business days from the date money was withheld from your employee.

    What constitutes earnings?

    Any payment or credit made to your employee, regardless of source.

    What is the maximum amount I can withhold from my employee?

    Do not withhold more than 50 percent of the employee’s disposable income unless the court order specifically says to do so. Never withhold more than 65 percent.

    I have two employees with wage assignments to your office. May I combine the withheld amounts and write one check to your office?

    Yes. Please include each employee’s Full Name, Member ID#, Social Security Number, Pay Date and the amount of child support to apply to each account/employee case.

    I have an employee with more than one assignment order to your office. May I combine the withheld amounts pertaining to each order and write one single check?

    Yes

    What do I do if an employee quits?

    You must notify our office immediately, so we can relieve you of your obligation.
